Updating Your Personal Information

SiteWyze will do its best to ensure that your personal information is correct and kept current. A customer service representative would contact you to verify your personal information before any decisions are made or action is taken based on that information. We will keep your information as long as is necessary to continue to meet your customer needs and any legal requirements we may have. However, once your personal information is no longer needed, we will destroy it. If your personal information changes, please inform us of the change and any other information you feel is necessary. Also, if your personal information is incorrect, then please notify us of the correct information.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

SiteWyze does not provide any refunds on website development, video production, online marketing, or trade show display orders. However, customer satisfaction is our top priority and we always work with you to make sure you are both satisfied with your project and that your project is completed accurately and according to your project outline/estimate. Please review your project estimate to make sure all functionality/products you require has been included and is accurate before proceeding with your order.

Basic WordPress Templates
Basic template hosting starts at $34.95/mo with additional add-on options outlined in this confirmation. Annual WordPress maintenance for basic websites is also required at a cost of $295/yr for core updates. Any misc updates required throughout the year for technical reasons are rare, but are quoted at $125/hr.

Email hosting includes up to 10 email accounts for $15/mo. Includes Webmail, POP3 and IMAP accessibility. Up to 2gb overall storage. On-going email support. Additional emails available for $1/email/month. Additional disc space available for additional fees (pricing may vary depending on how much additional you require).

Elite & Custom Site Development
Elite and Custom website hosting starts at $119/mo with additional fees for email hosting, database and e-commerce solutions as quoted in your project quote. Our Elite Package hosting includes everything you need to keep your website running smoothly, without any worries of add-ons for features like secure certificates, your own blog posts, e-newsletters, product stores, etc. All the power – none of the hassle!

CANCELLATION POLICY:

You can cancel services at any time however, if you cancel within the first 6 months after your website was completed, a one-time cancellation fee equal to 6 months of your hosting rate will be due.

Template/Starter Sites remain the sole property of SiteWyze. Should you cancel your template site hosting services with us, you are free to take any content (text and images) that you provided to us for use on your next website, however, all other site files remain the sole property of SiteWyze.

Custom Designed/Developed Sites remain the property of you, the client. Should you cancel your custom site hosting services with us, you are free to take any content (text and images) that you provided to us for use on your next website. If you would like a complete backup of all site files (excluding any SiteWyze-owned or other proprietary code), please indicate during your cancellation process (https://sitewyze.com/hosting-cancellation). There will be a one-time fee payable in advance of the backup being completed.

Stored Email Accounts & Data remain the property of you, the client. Should you cancel your email hosting services with us, you are responsible to ensure that your emails have been successfully downloaded from our server so that you do not lose any old, stored email data. If you would like a complete backup of all email files, please indicate below. There will be a one-time fee payable in advance of the backup being completed.

Cancellation must be confirmed using this form prior to the next billing cycle (30 days notice is required).

There are no refunds if you cancel your hosting in the middle of a paid hosting period.

DATA PROTECTION & STORAGE

Customer Data. You, the Customer, are ultimately responsible for the security and content of all of your data stored in SiteWyze’s hosted environment and any data, applications or third-party services run in or through the SiteWyze provided environment (”Customer Data”), and your Customer Data is, and at all times, shall remain your exclusive property.

Backups. SiteWyze provides a series of regularly scheduled backups of your website and data on a daily, weekly and monthly basis, one overwriting the next in succession. You,  the client, also have the ability to request periodic backups and copies of your files at our current hourly rate, with a minimum of 2 hours allotted to each requested backup. SiteWyze has no liability for any lost or corrupted Customer Data resulting from the provision of Courtesy Support.

Customer’s data stored at SiteWyze’s data center(s) or stored on or processed on SiteWyze’s systems is considered to be Confidential Information.

This Privacy Policy does not apply to your website hosted by SiteWyze. You, the Customer, are solely responsible for the information you store in our hosting environment. You, the Customer, are also responsible for all compliance with applicable laws, regulations, and SiteWyze’s terms related to the collection and storage of personal information.

INTERNATIONAL TRANSFERS

SiteWyze is a Canadian company and stores your information in its data centers in the United States or, in limited cases, in the Netherlands. SiteWyze may transfer your personal information to countries other than the country in which you live. Please note that privacy laws in the locations where we handle your personal information may not be as protective as the privacy laws in your home country.

NOTIFICATION OF DATA BREACHES

Security. Customer shall request encryption at the application level all Sensitive Customer Data. “Sensitive Customer Data” means Customer Data that is required to be treated as confidential under provincial or federal law or under Customer’s contractual obligations to others Information. You, the Customer, shall promptly notify SiteWyze as soon as you become aware of any data breach or unauthorized access to SiteWyze’s network, servers, or accounts. You, the Customer, will take all commercially reasonable steps to cooperate with SiteWyze’s investigation and resolution of a reported breach or unauthorized access. Notwithstanding the preceding, you, the Customer, acknowledge and agree that SiteWyze makes no representation or warranty regarding the security of its services.

Access and Use. SiteWyze is not responsible to Customers for unauthorized access to Customer Data or unauthorized use of the Services through authorized or unauthorized access provided by you, the Customer, to third parties. You, the Customer, are responsible for the use of the Services by any of your employees, affiliates, officers, directors, shareholders, agents or representatives, or any other third party whom you give access to the Service, and any third party who gains access to Customer Data or Services as a result of your failure to use reasonable security precautions, even if such access was not authorized by you.

No Liability for Certain Actions. SiteWyze shall not be liable to you, the Customer, for any claims or damages resulting from or caused by:

(a) Unauthorized access to transmission facilities or premises equipment, or for unauthorized access to or alteration, theft, or destruction of data files, programs, procedure, or information through accident, wrongful means or devices, or any other method where such unauthorized access is due to a Customer’s fault, negligence or failure to perform your responsibilities as a Customer.

(b) Your fault, negligence or failure to perform your responsibilities as a Customer.

(c) Claims against you by any other party.

(d) Any act or omission of any other party.

(e) Equipment or services furnished by a third party.

SiteWyze is not responsible for your Customer Data or the content of any other information transmitted or received through the Services.

DATA RETENTION & SECURITY

When SiteWyze no longer has a legitimate business need (e.g. termination of a Customer agreement) to process your personal information, we will either delete or anonymize it. If in the case of a termination of the Customer Agreement, you will be provided with the opportunity to request a final backup copy of your website data at a cost per hour, and all information will be deleted from our servers once the account termination date has passed.

SiteWyze takes all reasonable steps to protect information received from you from loss, misuse or unauthorized access, disclosure, alteration, and/or destruction. We maintain technical, physical, and administrative safeguards to secure your information, and we use industry-standard encryption for your data that is transferred over the internet. Despite its use of encryption, SiteWyze cannot guarantee any method of transmission of information over the internet is 100% secure.
